Terms of use

These terms cover the Fitness Mastery app, published by Tomic Systems, LLC. Using the app means you accept them. Your coaching agreement is separate and covers the coaching itself.

1. This is not medical advice

The app is a coaching and tracking tool. Calorie targets, macronutrient targets and training programs are coaching guidance, not medical advice, diagnosis or treatment.

The numbers are estimates. Food data comes from public databases and from labels, both of which contain errors, and portions you enter yourself are approximations.

Talk to a doctor before you start or change a training or nutrition program. That goes double if you are pregnant, have a history of disordered eating, or have any condition affected by diet or exercise. If something hurts, stop and get it looked at.

2. Your account

Your coach creates your account and sends you a temporary password. The account is yours alone, so do not share it. Email support@fitnessmastery.com if you think someone else has access to it.

3. Your data

What you log is yours. Your coach and our coaching staff can see all of it, which is how the coaching works rather than a side effect of it. The privacy policy sets out the detail.

You can erase everything from Settings, then Delete account.

4. Fair use

Do not break into other accounts, interfere with the service, scrape our data, or use the app unlawfully. We may suspend an account that does.

5. Availability and liability

We provide the app as it is. Servers go down and updates introduce bugs, so we do not promise it will be available or error free at any given moment.

As far as the law allows, Tomic Systems, LLC is not liable for indirect or consequential loss, and our total liability is capped at what you paid for the app itself. The app comes with coaching and is not sold separately, so that figure is zero. Nothing here limits liability that the law does not allow us to limit, including for death or personal injury caused by negligence.

6. Changes and ending

We will tell you in the app or by email before a material change takes effect.

Your access ends when your coaching ends, or when you delete your account. We may end it if you break these terms.

7. Governing law

The laws of the State of Florida, United States.
